Gather — Terms of Service & End User License Agreement

These Terms are a binding agreement between you and Victor Skaar (“we”, “us”) governing your use of the Gather mobile app (“the app”). By creating an account or using the app, you accept these Terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 16 years old to use Gather and confirm this at sign-up. By using the app you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us at vnskaar@gmail.com of any unauthorized use.

3. Acceptable use

You agree not to use Gather to:

• post content that is unlawful, hateful, harassing, threatening, defamatory, sexually explicit, or that infringes others’ rights;
• impersonate any person or misrepresent your affiliation;
• upload malware, attempt to breach security, scrape, or reverse-engineer the app;
• send spam or unsolicited invitations, or harvest other users’ information;
• use the app to organize or promote illegal activity.

4. User content

You retain ownership of the content you create (events, groups, photos, messages). By posting it, you grant us a limited, worldwide, royalty-free license to host, store, and display that content solely to operate the app and show it to the people you share it with. You are responsible for the content you post and confirm you have the rights to it.

5. Moderation, reporting, and blocking

We do not tolerate objectionable content or abusive behavior. The app provides tools to report content (events, groups, and messages) and to block other users. We review reports and may remove content or suspend or terminate accounts that violate these Terms, within 24 hours of a valid report where appropriate. We may act at our discretion to keep the community safe.

6. Termination

You may delete your account at any time in the app. We may suspend or terminate your access for violation of these Terms. On termination, your right to use the app ends and your data is handled per the Privacy Policy.

7. Disclaimers

The app is provided “as is” without warranties of any kind. Gatherings, events, and interactions arranged through the app are between users; we are not a party to them and are not responsible for what happens at events or for the conduct of other users. We do not guarantee the app will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the app. Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory rights as a consumer under Norwegian and EU law.

9. Governing law

These Terms are governed by the laws of Norway, without prejudice to mandatory consumer-protection rights you enjoy in your country of residence. Disputes are subject to the ordinary courts of Norway unless mandatory law provides otherwise.

10. Changes

We may update these Terms; material changes will be communicated in-app. Continued use after an update constitutes acceptance.

Apple App Store users

This app’s licensed application end-user license agreement (EULA) is between you and Victor Skaar only, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Maintenance, support, and warranty claims are our responsibility, not Apple’s.
